High Court Allows 15-Year-Old Rape Victim To Terminate 28-Week Pregnancy

The Madhya Pradesh High Court has allowed a 15-year-old rape sufferer to terminate her 28-week being pregnant.

Justice Vishal Dhagat directed medical consultants to terminate the being pregnant of the 15-year-old daughter of the petitioner by taking utmost care and precaution as per customary pointers mentioned advocate Sharda Dubey who represented the mom of the woman.

The High Court allowed the petition on April 9 after taking the report of the chief medical officer on document, she mentioned.

As per provisions of the Medical Termination of Pregnancy Act, abortion past 20-weeks of being pregnant may be carried out solely with the excessive court docket’s permission.

The woman was raped by her cousin in November 2020 when her dad and mom and different family members have been away for work, Ms Dubey mentioned.

The dad and mom reported the matter to the police on March 19, 2021, after they seen bodily modifications of their daughter.

“If pregnancy is not terminated, there are remote chances that the baby will be born alive and chances of survival are very low. Even if the baby survives then she can suffer from a physical and mental disability.

“There isn’t any psychiatric dysfunction however the petitioner’s daughter doesn’t appear to be mature sufficient to maintain her child,” Ms Dubey mentioned quoting the report of the chief medical officer.
